Collectively Bargained Agreements

Each Collectively Bargained Agreement (CBA) is bargained by a committee of members with experience in the appropriate arena (e.g., members with experience in LORT negotiate the LORT contract). They negotiate with a group of producers who represent management in that arena. The agreements generally last three to five years, and include terms of compensation, property rights protections, working conditions and the obligations of both Artist and Employer.

SHAKESPEARE AGREEMENT


The Shakespeare Agreement is for theatres and festivals primarily involved in the production of Shakespeare’s works. This contract sets minimum compensation and health contribution amounts based on a theatre’s category. The pension contribution is 8% for all categories. The determination of a theatre’s category takes into account an organization’s annual income, the number of productions per season, the top ticket price, the number of days the director/choreographer is in residence and the number of performances of a production. This category is determined per production. Also included are provisions for rehearsing in rotating repertory, fight choreography and short term choreography.   Like the Tier contract, there is no union security requirement on the Shakespeare contract.

Shakespeare contracts must be filed prior to the first rehearsal with accompanying health and pension contributions.

REGIONAL COMMERCIAL AGREEMENT


As of January 1, 2007 producers wishing to hire SDC members for commercial productions in 100-499 seat theatres outside NYC must use the Regional Commercial Agreement (RCA).

This is a promulgated agreement, not collectively bargained.

The SDC Member must be sure that:

SDC Contract Representatives are notified of the activity with enough notice to ensure that the producer posts bond prior to the first rehearsal and that the contract is completely executed and filed with SDC prior to the commencement of rehearsals.

Regional Commercial contracts WILL NOT be accepted by SDC if received after the commencement of rehearsals, and SDC members may be subject to fines for working without a filed contract.

TIER CONTRACTS


The Tier Contract should be used for productions at Theatres that are not covered by or referenced to a collectively bargained agreement or subject to the Regional Commercial Contract. The Tier Contract sets compensation minimums based on seating capacity, number of performances and ticket price. Property rights and rights of first refusal are protected under the Tier Contract. The Employer will be responsible for a pension contribution of 8% of all compensation, plus a fixed health contribution.

The electronic Tier Contract form has been designed to calculate the appropriate tier automatically. Employers should complete the form electronically and allow the form to calculate the Tier category. The contract form will provide the proper Tier classification as well as the appropriate health contribution. Once the contract has been completely filled in, print, sign and mail copies, along with the appropriate health and pension contributions, to the SDC.

The Tier Contract is NOT for use on commercial productions outside of NYC in theatres with seating capacity of 100-499. Unless a production falls under the jurisdiction of another collectively bargained agreement, the Regional Commercial Agreement should be used for such activity.

ACADEMIC INSTITUTIONS


The following is the SDC Policy regarding members working in a college or university setting:

Full-time teachers who direct student productions as part of their teaching assignments are not required to file SDC contracts.

Director/Choreographers jobbed into a college or university for the specific purpose of directing or choreographing any production are required to file a contract.

Guest or part-time teachers must determine if more than 50% of their time is spent directing and/or choreographing. If so, an SDC contract must be filed.

Academic institutions such as High Schools, Community Colleges, Certification Programs, Colleges and Universities can use the Academic Tier Contract, which was developed to address and accommodate the particular needs of such institutions.

Some academic institutions have difficulty signing contracts with outside unions due to state regulations or other reasons. In such cases, members can file the Academic Tier Contract through PES Payroll, Spotlight Payroll, or use the University/Resident Theatre Association (U/RTA) contract. These companies provide services as Employer of Record to academic institutions on behalf of SDC members. Below are links to PES, Spotlight and U/RTA.

SPECIAL CONTRACTS


The Special Contract is available for use only when pre-approved by SDC for projects that are either exempt under SDC Work Rules, do not fall under a collectively bargained agreement or not appropriate to the Tier contract. Projects for Special contract use will include but may not be limited to: Benefits, Concerts, Cruise Ships, Industrials, and Readings.

Producers and SDC members interested in requesting the Special contract may do so by clicking on the request link below. Based on the submitted information, SDC will determine whether the activity is appropriate for the Special contract.

Special contracts must be filed prior to the first rehearsal with accompanying pension and health contributions. Late contracts WILL NOT be accepted by SDC if received more than 90 days after the first rehearsal.

NYMF CONTRACTS


The NYMF Contract should be used only for productions that are part of the New York Musical Theatre Festival (NYMF). The NYMF Contract sets a minimum compensation and the Employer is responsible for a pension contribution of 8% of all compensation plus a fixed health contribution of $500. Property Rights and rights of first refusal are protected under the NYMF Contract

The NYMF Contract is NOT for use on any other productions including other New York City festivals.

NYMF Contracts must be filed prior to the first rehearsal with accompanying pension and health contributions.
